About Reset Fitness LLC

  • The Reset digital applications (App) website at: www.reset.app (Website) and fitness and nutrition services and products (Fitness Products) are owned by Reset Fitness LLC (‘Reset’, ‘we’, ‘our’, or ‘us’).
  • Reset offers a variety of Fitness Products which are promoted via the Website and through in-app purchased via Apple and Google that are included but not limited to:

Digital Products:

  • Monthly Subscription. – delivered by our mobile application for both Android and iOS which can be downloaded to your mobile device;
  • Annual Subscription. – delivered by our mobile application for both Android and iOS which can be downloaded to your mobile device;

Physical Products:

  • A range of physical products including a water bottle, jump rope, booty bands, sports towel, and message roller delivered inside our single SKU “The Essentials Box” (items not sold separately).

‘Reset’ does not offer face-to-face personal training and does not offer individually tailored exercise, fitness, or nutrition advice. All of the content provided in the app in regards to the fitness programs and nutritional guides provided by Reset (Programs) are generic programs based on the individuals’ goals filled out in the sign-up process through the App or the Website and any other limited personal information you provide. These are exclusively meant to be used as general guidelines for health management and consulting with a doctor is always recommended before starting any fitness program.

  • After purchasing a subscription that is provided on either the Reset App or the Website (www.reset.app); the purchaser will be granted the specified number of months that they requested app access for. The available app access times to purchase are as follows: 1 month and 12 months. This access period is valid starting from the date that the account is created and payment is rendered. If there is a free trial or other promotion at the time of purchase, then your app access will start at the time the promotion or free trial ends. At no time will this access be extended unless proof of an emergency medical condition can be issued — The Programs listed in the Reset App do not take into consideration any medical conditions, whether you are pregnant or breastfeeding or any other health or medical issues specific to you. — If you suffer from, or may suffer from, a medical condition or health concern, or if you are pregnant or breastfeeding, then it is especially important that you consult your medical practitioner before taking part in any Program. — Reset does not guarantee any particular outcome as a result of your participation in a Program, use of meal plans or nutrition guides, or other Fitness Products. All testimonials provided on the website are unique to that particular individual and results may vary.

2. Terms of Use

  • By registering an Account with Reset, or using either the App or Website in any way you will be acknowledging and agreeing that you: — Have read and understood these terms and conditions and agree to be bound by them; — consent to the use of your personal information for the purposes set out in these terms and use of the App particularly. — Reset may amend its terms and conditions from time to time and will post its updated terms on the Website and App for easy access to these updates.  The date of posting the amended terms on the Website and the App will be the date the new terms come into effect and it is important to understand that these terms will then apply to you. Your continued use of the Website and the App, Fitness Products, and purchase of goods and services from Reset after posting of the amended terms will indicate your acceptance of the amended terms.

3. Registration on a Program and license

  • Customers must be at least 18 years old in order to register an Account on either the Website or App along with using or accessing any Fitness Product or participate in a Program. — Each purchase of a Fitness Product is for you as an individual only.  You may not authorize third parties to use any Subscription, or other digital product or service supplied by us to you via your Account. — On registration of a Subscription, Reset grants you a limited non-exclusive, non-sub licensable, non-transferable, and revocable license to use the materials provided with the Subscription in accordance with these terms and conditions and solely for your personal use.

4. Paying for Subscriptions and Refunds

  • Customers must pay for all Fitness Products and other goods or services ordered through the Website at the time of purchase using the credit card payment facility, ApplePay, GooglePay, or via PayPal in the Website. — Absolutely no refunds are available in respect of any of the Fitness Products, or Subscriptions. No exceptions. All sales are final upon purchase. — Any payments processed through the App Store or Google Play Store Platforms will have to be dealt with by their respected entities separately. We have no control over the processing of payments from these platforms.

5. Exchanges

  • Due to the complexity of our logistics network and the nature of only offering a single product we offer no exchanges for “The Essentials Box”.

6.Faulty Equipment

  • If you have received faulty to missing equipment be sure to reach out to support@reset.app immediately and we will assess the fault and condition of the merchandise. In the event that this happens we will immediately issue a replacement for the product(s) via shipping paid by Reset Fitness LLC.

7.Privacy

  • Reset takes protecting your privacy very seriously and is always a top priority for us. — When you register an Account or purchase a Fitness Product, we will have access to the personal information about you that you list. We will protect this information and only use, disclose or deal with this information in accordance with our Privacy Policy listed here. — Any personal information you provide to us will be collected for the primary purpose of providing you with access to and use of the Website and participation in Subscriptions and use of Fitness Products, along with making your experience as pleasant as possible. — Reset conducts its business across The United States of America, The State of Texas, and the rest world and may need to share personal information with third parties for the purposes of providing the Reset goods and services and conducting its business (Purposes). — Customers consent to the disclosure of their personal information for the Purposes including to overseas recipients. — We may use email to communicate with you from time to time. We may send you information about Reset exclusively by email. — The reason for this contact is could be but not limited to: — administer accounts and process payments; — communicate with you regarding any issues affecting your registration on a Program or use of the App or Fitness Products; — provide information on services and benefits available to you through the App; — provide reminders of Subscriptions key dates; — provide you with our newsletters and updates about our services or special offers available to you; and — conduct market research or surveys to improve the services provided by Reset. — If you do not wish to receive any communications from us, please advise us or alternatively follow the ‘unsubscribe’ instructions provided at the bottom of the emails. Customers acknowledge that if they opt-out of receiving communications from us, this may adversely affect your use of the App or participation in a Program.

8. Reset Forum Community Guidelines

  • The Reset Forum is a dedicated place for women to share their experiences, gain knowledge, find inspiration and develop encouraging friendships during their health and fitness journey. Many women believe the key to reaching their fitness goals lies in having support and advice along the way, and this is something that we absolutely agree with! — We encourage users to post content that is helpful, not harmful. We ask that you be respectful and supportive of each community member and respect their own journey! — In order to help us all achieve this, we have a few simple guidelines we ask all users to adhere to:

  • Always respect other opinions and be polite
  • Cursing and other forms of profanity are strictly prohibited and will be moderated
  • Absolutely zero tolerance for bullying or demeaning comments
  • Only post things within the confines of the law or risk losing your access without a refund
  • Never post any mental illness-related content including but not limited to: suicide, anorexia, depression, etc.
  • Any spam or advertising of other products is strictly prohibited
  • Always use disruption and understand that anything that you post is public information and can be used against you without liability to Reset.
  • Do not post, publish, distribute or display sexually explicit images or words
  • Reset always reserves the right to remove any content and any information posted on any App or website forum which Reset considers breaches the rules set out in this agreement.

9. Suspension of your Account or use of the Reset App

  • Reset may suspend or terminate your Account or registration on the Reset App at any time should it consider that you have breached these terms and conditions or it is otherwise appropriate to do so. — Reset will suspend or terminate the Account by written notice to the User (which will include notice by email used to create your account). This may include but is not limited to when a User is being investigated by Reset or where the Customer is believed to be breaking the rules listed above in the community rules located inside the Reset App. — Customers may stop using a Subscription, the App, and the Website at any time they wish.

10. Complaints

  • Customers may raise a complaint regarding any goods or services rendered by Reset or any other matter concerning Reset by simply emailing: support@reset.app — Customers must outline the complaint in detail including the nature of the complaint, and attach copies of any documentation which supports the complaint. — Reset will investigate the complaint and a response will be issued within 7 business days.  

11. Risk Warnings and Disclaimers

  • You acknowledge and agree that there are obvious risks in undertaking any exercise routines and programs and that while taking part in any of the Reset Programs or using any Fitness Products, you may be at risk of death or personal injury including broken bones, soft tissue injuries (including injuries to tendons, muscles, ligaments, connective tissue, nerve damage, fibrous tissue and blood vessels), joint injuries, heart, lung and breathing problems due to:
  • known or unknown health problems or previous injuries;
  • pregnancy
  • engaging in activity that is too strenuous for your level of fitness and health;
  • tripping or slipping – including over fitness equipment both at home and in a gym; and
  • attempting an activity that is beyond your exercise capability.
  • You understand that any exercise and nutrition guides offered, conducted, or promoted by Reset are not individually tailored to your personal circumstances and you must seek advice from your medical practitioner before following any advice or plan as well as participating in a Program defined by Reset.
  • Reset does not guarantee that the Website and App will function on any particular device and Customers acknowledge and agree that the Website and App may suffer from technical difficulties or delays on any given day and that this is an inherent risk of any and all internet and electronic-based systems.

12. Warranties (by Customers)

  • You represent and warrant to Reset that:
  • you are 18 years old or over;
  • you have sought and obtained advice from your medical practitioner before beginning any Program or following any meal plan or nutrition guide supplied by us inside the Reset App;
  • all information and documentation provided to Reset is true and accurate and not misleading in any respect;
  • you will exercise in a place that is safe and suitable for the Program; and
  • you will abide by these terms and conditions at all times.
  • you will be solely responsible for the management of any food allergies or intolerances you may have.

13. Limitation/exclusion of liability

  • Customers acknowledge and agree that Reset excludes all liability to Customers to the maximum extent permitted by Texas State law.
  • In particular, we are not liable for:
  • negligence or fault of Customers;
  • the acts or omissions of a third party unconnected with the provision of goods or services by Reset Fitness LLC;
  • any defect in or complaint about the quality, suitability or availability of a Program or Fitness Product;
  • delays in the functionality of, or inability to access the Website or an App (and to this end Reset does not guarantee or warrant that the Website or the App will be uninterrupted or error free); and
  • any dialogue between Customers which is defamatory, libelous, unlawful, or offensive way towards other Customers or third parties.
  • We are not liable for your failure to identify any dietary restrictions connected with food allergies or intolerances, whether known or unknown.
  • Customers agree and accept that the entire risk arising out of your use of the Website and participation in Programs and use of goods and any other services purchased through the Website remains solely with Customers to the maximum extent permitted by law.
  • Reset will not be liable for any indirect, incidental, or consequential damage including loss of profits, lost data or lost Customer Content, personal injury, death, or property damage in connection with or referable to a Customer’s use of the Website or App or other goods or services provided in connection with or referable to the Website and any Program.

14. Indemnity

  • Customers agree to indemnify and hold Reset and its managing members of Reset Fitness LLC, directors, employees, and agents harmless from any and all claims arising out of or in connection with:
  • a Customer’s use of the App or participation in Programs;
  • use of products purchased through the Website;
  • a Customer’s breach of these terms and conditions;
  • our use of your Customer Content;
  • a Customer’s breach of duty of care, or negligence towards another Customer; or
  • a Customer behaving in a defamatory, libelous, hateful, aggressive, violent, obscene, unlawful, or offensive way towards other Customers or third parties.

15. Notice

  • We may give notice to you any and all notices via email to your email address with which you created your account with. All customers may give notice to us by email at support@stagging2.reset.app

16. Assignment

  • Reset may assign or transfer the rights and benefits under this agreement and sub-contract our obligations under this agreement to a third party in whole or in part at any time without the approval of the Customer.  
  • Reset may transfer ownership of the Programs, App, and the Website at any time without the consent of the Customer and the Customer hereby consents to the transfer and disclosure of his or her personal and sensitive information (including all information the customer has provided including but not limited to health and banking information) to any purchaser of Reset or its business and assets.

17. Severance

  • If any provision of these terms is found to be illegal, invalid or unenforceable, in whole or in part, under any law, then such provision or part of it will be deemed not to form part of these terms and the legality and enforceability of the other provisions of these terms will remain unaffected and enforceable.

18. Entire Agreement

  • These Terms constitute the entire agreement between Reset and Customers and replaces and supersedes all other prior agreements or undertakings between the parties.

19. Intellectual Property and Ownership

  • The App, the Reset logo and trademarks, the Brand and these terms and conditions, all the content of Programs, Website, Fitness Products, Subscriptions and any materials we provide to you in connection with the App or a Program (Reset Intellectual Property), will at all times remain our property and are subject to copyright and other intellectual property rights under The United States of America and Texas State law, international conventions and other laws.
  • You undertake not to copy, publish or reproduce in whole or in part, the Reset Intellectual Property except as is expressly permitted by these terms and conditions.

20. Governing laws

  • These terms and conditions will be governed by and construed in accordance with the laws of the state of Texas, United States of America.
  • All parties hereby submit to the jurisdiction of the Courts of Texas, United States of America.

21. Your acknowledgments and consents

  • By registering an Account you acknowledge and agree that:
  • you have read and understood these terms and conditions and agree to be bound by them;
  • you are responsible for all costs incurred by you with respect to your usage of the Programs, and Apps on a mobile device including data usage fees and other telecommunications fees;  
  • you give permission for Reset to disclose your personal information in accordance with these terms and conditions; and
  • you consent to receive any communications from us as outlined above, although you may opt-out at any time.
